Terms & Conditions

Overview

These Terms exclusively govern your relationship with Jen Lewin DBA Babes in the Woods (henceforth referred to as “BITW”). Please read these Terms carefully before using the Service and engaging in the Activity.

 

Your access to and use of the Service is based on your acceptance of and compliance with these Terms. These Terms apply to all visitors, Participants, and others who access or use the Service and engage in the Activity.

 

By accessing or using the Service you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these terms and conditions, in whole or in part, please do not use the Service or engage in the Activity.

Refunds, Rescheduling, and Cancellations

BITW operates the dayhike portion of the course rain or shine. Dayhikes will not be cancelled due to weather except for in extreme circumstances.

 

RESCHEDULING:

To reschedule your course, please notify us 7 days in advance of your dayhike. We would be pleased to help you find another weekend that will work for you. Courses can be rescheduled up to 2 times, free of charge, after which point further reschedules or refunds will be assessed on a case-by-case basis and are not guaranteed.

 

CANCELLATIONS:

Participants who need to cancel outright will receive a 100% refund if we are notified at least 7 days in advance of your dayhike, and a 50% refund if we are notified any fewer than 7 days prior to your dayhike.

 

ILLNESS OR INJURY:

If you need to miss our dayhike due to unexpected illness or injury, please give us the courtesy of letting us know at your earliest convenience, and we would be happy to reschedule the dayhike portion of your course. Preference will be given to rescheduling, rather than outright cancelling, dayhikes due to illness or injury. Refunds will be assessed on a case-by-case basis and are not guaranteed if they fall within the fewer-than-seven-days window. 


 

IMPORTANT NOTES ON CANCELLATIONS, REFUNDS, AND TRANSFERS:

 

Participants may replace themselves with another person at no cost, provided the new Participant meets all prerequisites for the Program. BITW reserves the right to cancel Programs at any point, in which case all fees collected will be refunded. BITW is not responsible for any expenses resulting from cancelled programs, regardless of reasons for cancellation. BITW reserves the right to waive all or part of the above-noted fees and restrictions.

Fees

Unless noted otherwise, fees for Schedules Programs cover the cost of Guiding and/or Instruction, specified safety/technical equipment, all required permits, Guides/Instructor expenses, course materials, and certifications where applicable. Costs do not include food, transportation, accommodation, or personal equipment on most of our Scheduled Programs unless noted on the Program page.

Prerequisites, Age Limits, and Joining Policies

Programs are open to anyone who is in good health and fitness who meets the specific prerequisites listed. 

 

Participants aged 16 and up are permitted to join Activities. Participants under 16 years of age will be assessed on a case-by-case basis as to the appropriateness of their inclusion in the Activity. Participants under 19 years of age must have parent or guardian approval. 

 

BITW reserves the right to refuse a participant for any reason, including inadequate clothing or equipment, inappropriate fitness level, or inability to meet program prerequisites.

 

All Participants must complete and sign a Waiver release form before participating in a BITW Activity. Participants must disclose requested information fully and to the best of their ability to ensure the safety of everyone taking part in the Activity.

Online Learning and Evening Meetup

Programs include an online program to be completed at the Participant’s convenience. When Participants enroll in any BITW Program, they will receive an information package with instructions on how to access their online learning modules. The online portion must be completed prior to our scheduled Zoom evening meetup (this will usually take place on the Thursday evening before our dayhike), at which time Participants can ask questions they may have, and details will be given regarding the meetup place for the dayhike as well as any further instructions. If you cannot attend the Zoom evening meetup, please let us know in advance so that we can make alternate arrangements with you.

Limitation of Liability

Participants, their heirs, executors, administrators, and assigns, release and forever discharge Jen Lewin, carrying on business as Babes in the Woods, its directors, officers, employees, guides, instructors, leaders, contractors, volunteers, and managers, from and against all claims, actions, costs, expenses, and demands by reason of any damage, loss, death, or injury to the Participant’s person or property, howsoever caused, arising out of or in connection with my participation in the Activity, notwithstanding that the same may have been contributed to or occasioned by the negligence of BITW. 

 

Participants agree to hold harmless and indemnify BITW from and against all claims, actions, costs, expenses, and demands in respect of any death, injury, loss, or damage to the Participant’s person or property, howsoever caused, arising out of or in connection with the Activity notwithstanding that the same may have been contributed to or occasioned by the negligence of BITW.

Assumption of Risks

The Participant acknowledges and accepts that the Activity has inherent risks, hazards, and dangers (all of which may cause injury, death, discomfort, or damage to the Participant’s person or property) including, but not limited to, the following:

 

  • Snow avalanches that may be caused naturally, by the Participant or by other people, and may occur without warning

  • Injuries as a result of hiking, climbing, scrambling, or while engaged in any aspect of the Activity

  • Dangerous or difficult terrain, including challenging snow conditions, rough ground, river crossings, and off-trail travel

  • Unmarked hazards such as rocks, stumps, logs, crevasses, and other physical hazards found in a wilderness environment

  • Sudden changes in, and extremes of, weather conditions that can affect the safety of participants on the Activity

  • Equipment failure, including improper use of equipment and equipment malfunction

  • Being struck by falling rocks, ice, and other objects, either naturally caused or caused by other people

  • Falling on steep or difficult terrain, including falling while climbing, hiking, or scrambling on rock, snow, ice, and ground

  • Becoming lost in remote or inaccessible areas which may lead to delayed return or increased risk of injury

  • Unpredictable animals including bears, rodents, and other animals that may cause injury, death, or damage to property

  • All other risks, hazards, and dangers associated with the Activity and generally with travel in mountainous terrain

 

The Participant accepts that other actions and conditions can cause or contribute to the inherent risks, hazards, and dangers of the Activity, including, but not limited to, the following:

 

  • Failure to follow the directions and instructions of the Guides, instructors, or leaders

  • Inappropriate or inadequate equipment or clothing

  • Poor or inadequate physical fitness or health

  • Failure to exercise good judgment or pay due care and attention

 

The Participant accepts and fully assumes all such risks, dangers, and hazards and the possibility of personal injury, death, property damage, or loss resulting therefrom, and further agrees to bear all costs of rescue and medical treatment rendered to the Participant, or for the Participant’s benefit, arising from the Activity.

 

The Participant confirms that they have read, understand, and accept the terms and conditions and accept its terms. In entering this Activity the Participant accepts that they are not relying on any oral or written representations or statements made by BITW with respect to the safety of the Activities, other than what is set forth in the Terms and Conditions.

Governing Law

These Terms will be governed by, and interpreted and enforced in accordance with, the laws in the Province of British Columbia and the laws of Canada, as applicable. 

 

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between BITW and the Participant regarding our Service, and supersede and replace any prior agreements, oral or otherwise, regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. 

 

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Service and attending these Activities.
